Please read these Terms of Service ("Terms", "ToS") carefully before using the OnTrend Shopify Mini app (the "Service") operated byVisualsoft ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all merchants, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
The OnTrend mini is designed for Shop App users. It integrates with the Global Shopify Catalog and pulls data from external, third-party sources (specifically, Google Trends). The Service analyzes this trend data to generate dynamic Daily Shoppable Categories intended to highlight relevant products to a customer linking through to the relevant stores for purchase.
You acknowledge and agree that: a. Data Source: The core functionality of the Service relies entirely on data provided by Google Trends (a third-party source). We have no control over the accuracy, completeness, or freshness of this external data. b. No Warranty of Accuracy: We do not warrant or guarantee that the categories generated based on Google Trends data are accurate, relevant to your specific inventory, or free from error. c. Changes to Data Source: We are not responsible for any interruption, inaccuracy, or cessation of the Service resulting from changes, failures, or termination of access to the Google Trends data source.
The Service is a tool designed to provide marketing suggestions based on trends. We make no warranties, guarantees, or representations regarding the performance, sales, profitability, or business results that may be achieved through the use of the generated Shoppable Categories. Your use of the Service is at your own risk.
a. Compliance: The Service complies with the Shopify Terms of Service, the Shopify API License and Terms of Use, and all other applicable Shopify policies.
b. Shopify Data: The Service does not require any additional restricted data from merchants or customers. Global Catalog data from Shopify is utilised solely for the purpose of providing the Service.
The Service is currently provided to you free of charge. We reserve the right to introduce fees for future features or versions of the Service, subject to providing you with prior notice. Your continued use of the Service after any fee introduction will constitute acceptance of the new pricing terms.
a. Our IP: The Service and its original content (excluding data sourced from Google Trends or your Shopify content), features, and functionality are and will remain the exclusive property of Visualsoft and its licensors.
b. Your Content: You retain all ownership rights to the content you submit to the Service, including your product listings, images, and other store data. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely as necessary to operate and provide the Service.
In no event shall Visualsoft, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service, including content derived from Google Trends data; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
